1 – Scope

These Terms of Service (“Terms”) apply to all contracts concluded via noel.marketing between Noel Dario Andres – Digital Solutions (“we”, “us”) and our customers (“you”).

Our offer is aimed at both consumers and businesses.

2 – Subject matter

We offer digital products (e.g. Astro themes, Framer themes, Framer components, Shopify sections/templates) and related services. Products are delivered electronically only (download, access, integration).

Shopify apps are offered through the Shopify App Store; App Store terms and any separate product pages apply where they differ from these Terms.

3 – Conclusion of contract

Your order constitutes a binding offer to purchase.
The contract is concluded when we confirm your order or deliver the digital product.
Please check your details carefully before ordering.

4 – Prices & payment

Prices are shown in the currency on the product page and include applicable VAT where required.
Payment is processed via Lemon Squeezy (merchant of record) using the methods offered there.
Access to digital products is granted only after successful payment.

5 – Delivery of digital content

Our products are digital goods.
Delivery occurs immediately after purchase via download or electronic access (e.g. Lemon Squeezy download link).
No physical shipping is involved.

6 – Right of withdrawal

We grant all customers a 14-day right of withdrawal.

Details are in our refund policy.

Note: For digital content, the withdrawal right expires once you expressly agree that we begin performance before the withdrawal period ends and confirm that you lose your withdrawal right as a result.

7 – Licence & use

Upon purchase you receive a non-exclusive, non-transferable licence to use the product as described on the product page (typically one production project unless stated otherwise).

You may not:

Resell, rent, sublicense, or publish the product as a template, theme, or component,
Use it across multiple independent projects without an additional licence where the product page says otherwise,
Bundle it into products or marketplaces for resale.

Product-specific licence terms (e.g. one Shopify store) are stated on each product page.

8 – Support & updates

We provide basic email support for a reasonable period after purchase.
Bug fixes and minor updates are included unless the product page states otherwise.
Major feature updates or custom work may be billed separately.

9 – Feedback & testimonials

By submitting feedback or testimonials, you grant us a royalty-free, worldwide licence to use, store, and publish them for marketing (website, social media, etc.). You confirm you have the rights to share the content. We may remove content that violates our policies.

10 – Intellectual property

All content (text, code, designs, digital products, trademarks) is protected by copyright. Use outside the licence in section 7 is prohibited.

11 – Warranty & liability

Statutory warranty applies.
We will provide remedies (updates, fixes) if a product does not work as described.
Our liability is limited to the purchase price of the respective product except in cases of intent, gross negligence, or injury to life, body, or health.

12 – Prohibited uses

You may not use our products for unlawful activity, malware, spam, or infringement of third-party rights.

13 – Privacy

Personal data is processed according to our privacy policy.

14 – Severability

If any provision is invalid, the remaining provisions remain in effect.

15 – Governing law & jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is our registered office where permitted by law.
